Employment Law in Security
Recruitment and selection processes are an essential part of an organization; effective recruitment and selection processes ensure that the organization is able to obtain quality employees as well as a productive work environment. Along with recruitment and selection processes, employments laws are also essential in today’s society. Particular laws are put into place to protect potential candidates from being discriminated against as well as those already hired to protect against maltreatment or inadequate reasoning for being let go. The recruitment and selection processes are no different as there are employment laws that are put into place to protect those who are applying for the position.
Major Laws and Elements that affect Recruitment and Selection
There is a plethora of employment laws throughout the country pertaining to the recruitment and selection processes of organizations. These processes must adhere to administrative laws and relevant federal guidelines. Some of the major laws pertaining to these processes are: Title VII of the Civil Rights Act of 1964; The Civil Rights Act of 1991; The Equal Employment Opportunity Act of 1972; Age Discrimination in Employment Act of 1967; Americans with Disabilities Act; The Immigration Reform and Control Act of 1986; and The Fair Labor Standards Act. Each law affects the recruitment and selection process in different ways.
Title VII of the Civil Rights Act of 1964, as amended, prohibits any and all discrimination on the “basis of race, color, religion, sex or national origin in any employment practice that includes hiring, firing, promotions, transfers and other employer activities throughout the employee’s tenure with the organization” (Johnson, 2005). Title VII of the Civil Rights Act of 1964 protects against disparate treatment and disparate impact.
