  Selected Answer:An example of a situation that can be described as a violation of the General Duty Clause is where a contractor in a construction site fails to put in the necessary safety procedures and also fails to provide his employees with the necessary safety equipment. This happens despite his knowledge of what ought to be done. A worker falls from the second floor after a brick being lifted to the third floor hits him. As a result, the worker breaks his arm, and his leg is twisted in an awkward position from the fall. This situation amounts to a violation of the General Duty Clause because the contractor knew that the hazard was likely to cause death. According to general duty violation standard, if a condition or activity in the workplace created hazard its considered as a violation. The poor safety conditions in the site caused the accident. The employer had knowledge of the hazard or he should have had knowledge because he has been fully trained for such cases (Occupational Safety & Health Administration, 2008). The hazard was foreseeable. It is normally considered as a violation if there was a feasible means to eliminate or materially reduce the hazard. The accident could have been prevented by ensuring that the necessary lifting mechanisms have been put into place. However, the contractor did not do that.
