The diverse Role of Judges
There are various diverse roles played by the judges. Judges play very important responsibility in making impartial decisions during the pursuit of the justice. They have a task of interpreting the law and ensuring that the evidence got from the research has been assessed fully to produce effective outcomes or judgments. In addition, judges are the sole controllers of all the trials and hearings made in the any court to ensure that the information does not unfold unnecessary. When the case is presented before the court, the judge provides independence to both parties by his or her impartial evidence derived from the facts of law. The judge passes the final decision concerning the defendant either to be sentenced or to be fined according to how the law applies. Judges are the final decision makers or they are the triers of facts to all cases presented to them (LaFromboise et al. 2010).
Judges should be independent because of the much external pressures they receive. Individual judges and judiciary should also be independent so that the clients trust them with their case knowing that the case would be fairly handled according to the law. Having independency makes the judges to make final decisions solely which are the best according to the facts of law. It is through independent that the judges can be able to discharge the constitution in order to provide fairness to the clients who are the citizens of the country. Judges should not misuse their independence to the citizens. The independence of the judges prevents the common man from knowing all what happens in the courts. This is because the press has got limited space, time and limited information to share to the people (Posner, 2006).
On the other hand, the judges are interdependent whereby they cannot exercise their powers according to the guidelines or provisions of the constitution. Individual judges and judiciary have no powers of deciding on what the act should be done. In addition, they have got no powers to control what has been written by the constitution. This means that they are interdependent with the constitution and cannot interfere with the parliament even when they are part of the branches of the parliament. This interdependence makes the judges not to make some judgments or charges to the accused. It is also important for interdependence of the judges because the citizens feel secure as they are protected by the law. Interdependence also ensures that the judges have not misused their powers on the citizens because of limitations of the constitution to the judges (Posner, 2006).
Conclusively, ethical and legal standards provide direction or guidelines to the criminal justice workers. Ethics and legal standards provide the meaning to both procedural and substantive law. Ethics and legal standards provides a bridge on how the participants interact, how the judges make the decisions and how they interpret the evidence presented to them ensuring that they make the best judgments according to the law. According to substantive law, the prosecutor must provide all the evidences concerning the crime whereby the judge should then be guided by the legal standards and ethics to make charges (LaFromboise et al. 2010).
