Juvenile Case Management
The Criminal Justice system is a system made up of laid down processes and whose main function is to minimize crime and punish law offenders. In most cases they are set up by individual governments to enable them to maintain law and order within a given country. Management in criminal justice refers to the complex process of strategic planning, objective selection, resource securing, and human resource provision and the necessary financial input in order to see that an organization meets its stipulated objectives in the criminal justice system. An organization in the criminal justice system is a composed group of people with specific objectives to meet or projects to fulfil within the system. Leadership within a criminal justice system refers to the process of controlling all the stipulated processes that occur in the system. The system has five main components which include Law enforcement, prosecution, courts, defense attorneys and corrections.
Case management is recognized widely as a process that considers, plans , gears organizes, monitors and evaluates the options and services required to meet the clients’ well-being. It is characterized by communication and management of the available resources in the promotion of the quality and cost effective interventions and the final out comes. This process is wholly a client based having the interest of the client at heart. The main goals here are to focus the attention to the clients’ emotional and physical and psychosocial status in the community, in particular the psychosocial status as well as the relationships after a long time away from the society.
Most of the resources that are availed in this corrective measure are gotten from various institutions. The cost of this system is not as cheap as one may want to look at it. The government in general seeks to ensure that the citizens are well taken care of whether they are offenders or non-offenders. It then goes further to ensure that the inmates receive proper training such that when the jail term ends they are able to fit well in the society and be able to catch up with the current community developments. Most of these programs or trainings are funded by the government by investing on the system. In other situations they are privately sponsored or are charitable-based sponsorships.
The correctional system in US has got various roles that are known i.e. Punishing, protect the general population and rehabilitate. Punishments were designed to act as a deterrent against repetition of the criminal act. There are lesser punitive measures that are given such as the probation. In this one in particular one is released but is expected to carry out certain activities in the community or the region allocated to him. Secondly is the role of protection. Other than punishments the correctional system looks into protecting the general society from criminals. There are those that must be kept away from the society to maintain order and peaceful coexistence and cannot easily harm the public or continue with their criminal acts. Third is the role of rehabilitation. The inmates are supposed to be rehabilitated. This makes the system more functional and of greater impact to the criminal or the offender in the position that it is done in a proper manner. It is intended to actually assist the criminal to transition from being a cost to the society to being a contributing member. Examples of the process include counseling and vocational training.
Juvenile program refers to the way in which the criminal justice views juveniles and the young offenders. Various programs and policies can be initiated to ensure justice is developed in the community and the juveniles are safe with the view of rehabilitating them as they get out to the community.
The objective of the programs are to reduce excessive use of courts and incarceration for less serious cases; reduce juvenile delinquency; reduce disparity and unfairness in sentencing; provide treatment and rehabilitative services that take into account the interests of the juvenile victims; ensure serious interventions and offenders held accountable; address development challenges for the young people and ensure public safety. In order to fund the programs a budget has to be created. The key programs include: Juvenile and Delinquency Prevention program, Youth Mentoring program, Juvenile prevention incentive program, Juvenile accountability fund, Community Based Violence Prevention Programs, Missing and Exploited Children program.
Youth mentoring program involves supporting mentoring activities by first time and recurrent youth involved in crime. The program helps in creating partnership with mentorship institutions, train on mentorship and incentive for volunteer mentors. The objectives met include addressing the development challenges of the youths and cause rehabilitative services. The funding would be directed to the mentors (Gaines and Miller, 2014).
Juvenile incentive prevention program supports local groups and governments to benefit the youths who are likely to fall into crime and hence into the hands of justice. It is best handled by local advisory groups. It helps to reach out to the youths before they are involved in crime. The objective is to rehabilitate the juveniles and prevent them from being involved in crime. The funding would be directed to the local organizations to support their activities (Schmalleger, 2012).
Juvenile accountability program ensure that the juvenile offender and juvenile justice system are held accountable for every step in the system. For the juvenile offender, accountability means the offender is made aware and held responsible for the loss, damage or injury that the victim experienced. It involves the offender facing the consequences. The funding would involve the legal counsels and prosecutors targeted to help the juveniles to appreciate the magnitude of their actions and hence appreciate the correction system (Cole and Smith, 2007).
Community based violence prevention programs involves using the best practices in various areas in the world and public health research for violence reduction. It requires public participation and public education to ensure behavior change, mind-set changes and attitude changes towards crime and violence. It involves research; selecting a target group, recruiting the target group, monitoring their activities and monitoring the changes. This involves applying the best strategies and evaluating their effectiveness. This involves partners and organizations- federal, state and local authorities. The objective of the program is to find sustainable approaches to reduce crime and violence. The fund would be directed to the various activities to ensure the community is able to find long term solutions to crime prevention (Gaines and Miller, 2014).
Missing and Exploited Children Program ensures that the children are not exploited and abducted. Exploitation involves engaging the children in hard labor, denying them going to school and social activities, subjecting the children to be accomplice to crime and violating children’s rights. An abducted child involves the breaking of federal law, and taking the children away from their parents, guardian and legal custodian. Funding for the program is directed to toll free services to ensure that the cases are quickly and well reported, followed up and correct channels of justice are sort. It involves forming a task force dedicated to juvenile cases both in the police department and in the justice department (Cole and Smith, 2007).
The Criminal and juvenile justice has got various planning for the predictability of the future of the criminal justice system. There are different frameworks that are available in understanding the future of the criminal justice. They include the crime control model, the due process model and lastly the crime control vs Due Process. The guide that is used in most cases to inform on the prediction of the system is the Herbert Packer’s model which describes the criminal justice process as the outcome of competition between two different value systems
Future management issues and trends regarding services are quite a lot and on the brief there would raise the issues such as financing, the efficiency of the measures taken as well as the services provided for the juvenile offenders and their respective impact to the society. The other issue that may arise is that of the transfer of juvenile cases to the adult court and be dealt with as adults in the sentencing considering the youths age, and the previous criminal history as well as the persons prior conduct before sentence. This would then work against my client, the minor in this case because the minor’s interest would not be considered to the maximum due to the formalities involved. This will equally hinder the minor from accessing the readily available services when transferred to the adult court because he/she will be considered mature person
Secondly, future trend in correction, community corrections and case management is in the issue of incarceration. This is always the final step taken for the minors in the juvenile section.it always involves supervision and allocation Some of the community works they are given exposes the minors to greater society which might not really assist the minor but rather increases the negative influences that would corrode the morals that they have acquired. This might be a threat to the community.
Thirdly, the juvenile courts are always aligned to seek out the issues arising as soon as they present but failing to actually outline the future longer term solutions that would safeguard the future occurrences. Juveniles are meticulously monitored by the probation officers and the parole. Due to the close check then the future of the corrections in juvenile is positive and the upright citizens.
Lastly, there would be developed resistance in the minor this arises out of laxity in the rules of probation and exposure. This would then lead to the rules applicable to be made strict in operation hence a disadvantage to the minors i.e. my client. Future trends are not just directed towards the negative but the positive as well. The corrective measures put in place helps reduce the overcrowding in the prisons and probative institutions. It also helps reduce recidivism and the crimes committed as well. Because of these advantages my client stands to benefit greatly by learning or having an opportunity that he had actually lacked and will assist the society in the end when released.
